29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:    (a)Jon C. Butler dba Premier at 1301 South Lindenwald Drive, Sioux Falls, SD 57106:  On or about and at times prior to May 14, 2019, the exposing employer did not ensure that frequent and regular inspections were conducted of the job site. The employer did not ensure employees were protected from fall hazards while conducting re-roofing operations on a single-family home without fall protection systems. Additionally, employees were exposed to a fall hazard associated with the extension ladder to the roof not extended at least three feet above the roof to provide safe access. This condition exposed employees to fall hazards of approximately 10 and 19 feet.

29 CFR 1926.501(b)(13): Each employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     (a)Jon C. Butler dba Premier at 1301 South Lindenwald Drive, Sioux Falls, SD 57106:  On or about and at times prior to May 14, 2019, the exposing employer did not ensure that employees were protected from falls. Employees were conducting re-roofing activities on a single-family home without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 10 to 19 feet.    Jon Butler was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1245462, citation number 1, item number 3a, and was affirmed as a final order on October 24, 2017, with respect to a workplace located at 3800 East 15th Street, Sioux Falls, SD 57103.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    (a)Jon C. Butler dba Premier at 1301 South Lindenwald Drive, Sioux Falls, SD 57106:  On or about and at times prior to May 14, 2019, the exposing employer did not ensure that the Werner 16-foot extension ladder Model # D1216-2, was extended at least three feet above the upper landing surface of the roof on a single-family home. This condition exposed employees to a fall hazard of approximately 10 feet.    Jon Butler was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1245462, citation number 1, item number 4b, and was affirmed as a final order on October 24, 2017, with respect to a workplace located at 3800 East 15th Street, Sioux Falls, SD 57103.
