29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  (a) New residential construction located on Lot #9, Rear side of structure: On or about 05/14/2019, and at times prior, the employer exposed employees to silica dust exposure while cutting Hardie-Plank Siding, in that the Makita 7-1/4-inch circular saw used to cut a fiber cement product was not equipped with a dust collection system as required by Table-1 when working with materials containing crystalline silica.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  (a) New residential construction located on Lot #9, Rear side of structure: On or about 05/14/2019, and at times prior,  employees were permitted to perform outdoor Hardie Plank Siding cutting operations with a circular saw not equipped with a dust collection system in an area were other employees were permitted to walk and work in close proximity to the cutting area which exposed these workers to materials containing crystalline silica.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  (a) New residential construction located on Lot #9, Rear side: On or about 05/14/2019, and at times prior, employees were exposed to fall hazards over 25-feet while working from a scaffold system without fall protection, not provided with required engineering controls for cutting fiber board products, or provided with the PPE while using these building materials, in that the employer did not perform frequent and regular inspections of the project and/or the employees making sure the siding installers were utilizing their fall protection and silica exposure reduction measures on the jobsite.  Bett Mart Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1269515, citation number 2, item number 1 and was affirmed as a final order on 12/15/2017, with respect to a workplace located at 2295 Melina Place, Alpharetta, GA 30009.  Bett Mart Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1225096, citation number 1, item number 1 and was affirmed as a final order on 05/12/2017, with respect to a workplace located at 4415 Atwood Drive, Lot #144, Cumming, GA.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  (a) New residential construction located on Lot #9, Rear side: On or about 05/14/2019, and at times prior, the employer exposed employees to fall hazards of over 25-feet to the lower level, in that a fall protection system was not used by siding installers on a pump jack scaffold.
