29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:    (a)T's Plumbing and Home Repair at 325 Joplin Street, Vermillion, SD 57069:  On or about and at times prior to May 15, 2019, the exposing employer failed to ensure a ladder or other means of egress was available in an trench excavation that measured approximately 9 feet in depth.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):    (a)T's Plumbing and Home Repair, at 325 Joplin Street, Vermillion, SD 57069:  On or about and at times prior to May 15, 2019, the employer did not ensure that employees conducting work in a 9-foot deep trench were protected from cave-ins, in that the there was no protective system within the trench.  The wall of the trench sloughed off trapping an employee in the trench until he could be rescued.  This condition exposed employees to struck-by and crushed-by hazards associated with a trench wall collapse.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift.   (a)T's Plumbing and Home Repair at 325 Joplin Street, Vermillion, SD 57069:  On or about and at times prior to May 15, 2019, the exposing employer failed to ensure that a competent person inspected a trench prior to work being performed in the trench.  The wall of the unprotected 9-foot deep trench collapsed, trapping the exposing employer in the trench.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations and protection was not  provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    (a)T's Plumbing and Home Repair at 325 Joplin Street, Vermillion, SD 57069:  On or about and at times prior to May 15, 2019, the exposing employer failed to ensure that adequate protection was provided, in that the spoils pile was placed directly on the south and west edge of the trench excavation.  This condition exposed employees to struck-by and crushing hazards.
