OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards due to potentially overloaded steel racking and shelving. Location: Yard area, inside storage area On or about May 16, 2019, employees were exposed to struck-by and crush-by hazards due to the following homemade racking and shelving with no capacity ratings; 1. Homemade steel shelving with three pallets of cement bags. 2. Homemade three tier steel racking with a scale, a pallet of cement bags, and a pallet of salt bags, and miscellaneous building supply materials.

Main path to office area - damaged pallet with cobblestone blocks stacked three high were not secured and stable. 2. Main path to office area - damaged pallet with blue stone patio slabs and a pallet of bricks stacked four high were not stable. 3. Main path to office area - stone slabs stacked two high were not stable. 4. Stone loading area - cinder blocks loosely stacked three tiers high were not secured and stable. 5. Stone loading area - one pallet of cinder blocks loosely stacked three tiers high was not secured and stable. 6. Stone loading area - cinder blocks loosely stacked over four tiers high were not limited in height and not stable in that several blocks located at the bottom tier were damaged. 7. Propane gas storage area - A stack of mesh wire stored 9-feet in height on top of concrete blocks and 2x4 wood boards were not secured and stable.
