29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:   On or about May 21, 2019:  a.  On the east side of apartment building 1 being painted, where an employee was exposed to a fall hazard exceeding six feet when working from the second level balcony without a fall protection system in place.  b. On the east side of apartment building 2 being painted, where an employee was exposed to a fall hazard exceeding six feet when working from the seond level balcony without a fall protection system in place.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  On or about May 21, 2019:  a. On the east side of apartment building 1, where an employee was exposed to a fall hazard while using an extension ladder to access the second story level balcony without extending the ladders side rails at least three feet above the railing on the balcony, securing the top of the ladder to the balcony, or other rigid support.  b. On the east side of apartment building 2, where employees were exposed to a fall hazard while using an extension ladder to access third level balcony without extending the ladders side rails at least three feet above the railing on the balcony, securing the top of the ladder to the balcony, or other rigid support.
