This condition exposed the employee to the hazard of improper forklift operation.     Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    Abatement Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than ten feet above a lower level was not protected from falling:      (a)Gumaro Hernandez at 1310 West 30th Street, Yankton, SD 57078: On or about and at times prior to April 24, 2019, the exposing employer did not ensure employees working from pump jack scaffolding located on the east side of a multi-family structure under construction were protected from falls. The pump jack scaffolding was not equipped with guardrails at the end of the platform and had an approximate 2-foot gap between the netting that exposed an employee to a fall hazard. Employees were exposed to a fall hazard of approximately 30 feet while working on the pump jack scaffolding.

29 CFR 1926.451(c)(2)(i):  Footings were not level, sound, rigid and capable of supporting the loaded scaffold without settling or displacement:                                                                                                           (a)Gumaro Hernandez at 1310 West 30th Street, Yankton, SD 57078:  On or about and at times prior to April 24, 2019, the exposing employer did not ensure the footings of the pump jack scaffold were secured to prevent displacement. Pumpjack posts were set on top of /4 inch plywood wood mud sills. The plywood mud sills showed signs of distress in the form of cracking based on the load or weight imposed, thus adding instability to the scaffold. This condition exposed employees to falls of up to 30 feet.

29 CFR 1926.454(a):  The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards:     (a)Gumaro Hernandez at 1310 West 30th Street, Yankton, SD 57078: On or about and at times prior to April 24, 2019, the exposing employer did not ensure each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards. Employees were installing siding on a pump jack scaffolding system while exposed to fall hazards. This condition exposed the employees to a fall of approximately 30 feet.     Abatement Note: The training shall include the following elements at a minimum:     (1)  The nature of any electrical hazards, fall hazards, and falling object hazards in the work area;     (2)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used:     (3)  The proper use of the scaffold, and the proper handling of materials on the scaffold;     (4)  The maximum intended load and the load-carrying capacities of the scaffold used; and     (5)  Any other pertinent requirements of this subpart.
