29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent. a) In the production area: Employees who were required to operate two separate router machines were exposed to noise at a time-weighted average of 86.9 dBA or a dose of 154.4% and 86.6 dBA or a dose of 150.8%, respectively. Condition noted on 05/29/19. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.

29 CFR 1910.217(b)(4)(i): Pedal mechanism(s) on mechanical power press(es)full revolution clutches were not protected to prevent unintended operation from falling or moving objects or by accidental stepping onto the pedals: a) On the new VB Machine: The employer did not ensure that a foot pedal guard of the "New" VP Machine was not bypassed. A piece of melamine board was inserted under the guard but over the pedal to allow the operator to activate the machine by stepping on it directly, thus bypassing the guard; Condition noted on 05/21/19. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE INSPECTION CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OF ABATEMENT FOR THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
