29 CFR 1926.20(b)(2): (Accident prevention responsibilities.) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On May 21, 2019, there were no frequent and regular inspections being performed by a competent person in that: an employee was performing truss grid work while standing on an overhead aluminum pipe structure and not utilizing an effective fall protection system; employees were using gear slings and mountain climbing harnesses as part of a personal fall arrest system while performing work from an aerial lift; employees were performing elevated truss grid work while not tied off and standing on the mid- and top-rails of an aerial lift; employees were using safety hooks as part of a personal fall arrest system that were not sized to be compatible with the member (aerial lift) to which they were connected; and employees were not provided with ANSI-compliant fall protection harnesses prior to beginning work at elevation.

The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On May 21, 2019, located at a commercial structure, employees working from a JLG 450AJ articulating boom lift while not utilizing a fall protection system were exposed to potential fall heights greater than 13 feet above the ground below. The employer did not instruct employees in the proper use of an aerial lift and in the recognition and avoidance of those hazards of which a reasonably prudent employer would have been aware of while performing this work.

A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).
