29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  (a) The employer did not ensure that the competent person was conducting frequent and regular inspections of the job site to ensure fall protection was being worn, that fall protection systems were installed properly and job site conditions were maintained safe.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  (a) The employer did not insure employees were trained to recognize the fall hazards they were exposed to, nor that employees were properly trained to utilize the proper fall protection for the tasks they were performing.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  (a) On or about May 23, 2019, employee(s) decking a second (2nd) floor balcony on the west side of the building were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately eleven (11) feet.

29 CFR 1926.1053(b)(1): Where a portable ladder(s) was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    (a)  The portable Werner extension ladder erected on the West side of the Structure, and being used for access to the balcony, did not extend at least three (3) feet above the awnings edge, and/or was not secured to the structure when it was not sufficiently extended.
