OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and crush-by hazards:  On or about 5/28/2019, in the auto lift work area located at 3600 Atlanta Highway, Loganville, GA: Employees required to use 23 Automotive 2- Post Lifts with defects and deficiencies such as but not limited to loose and broken support post mounting bolts, non-fully secured swing arm pins, uneven lifting and locking devices, no documented inspection of the lifts, while working underneath the raised lifts to perform service, maintenance, repairs, and inspections on the vehicles were exposed to a struck-by and crush-by hazards.  The employer did not ensured operators of the lifts daily, weekly and monthly before use inspections and perform required the manufacture annual inspections of the lifts.

29 CFR 1910.178(g)(1): Battery charging installations were not located in areas designated for that purpose:    On or about 5/28/2019, in the auto lift work area at 3600 Atlanta Highway, Loganville, GA: The battery charging area for the electric powered industrial truck is located in a room with stored chemicals, equipment, and other material.  The employer failed to provide a designated battery charging area for the employees to safely charge the battery on the lift and avoid any hazards that would arouse from the chemicals and equipment being stored in the location.

29 CFR 1910.178(q)(6): Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer.    On or about 5/28/2019, in the auto lift work area at 3600 Atlanta Highway, Loganville, GA: Employees operated powered industrial trucks with an metal personnel platform attachment attached to the forks of the lift that was used to lift personnel. The employer altered the powered industrial trucks from when originally received from the manufacturer without providing the employees a manufacturer approved attachment.  The employer indicated that they have one (1) non-approved attachment counterweight that they use to lift employees.
