(a) Anodizing Department- On or about May 16, 2019, the employer did not identify the Bright Dip Tank # 7, containing nitric and phosphoric acid as a as a permit required confined space.    In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. 29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces:      (a) Facility Wide - On or about May 16, 2019, the employer did not ensure that  a danger sign was posted on the permit confined spaces such as but not limited to Bright Dip Tank # 7 to inform employees of the existence, location and the danger posed by the permit space. The signs posted read caution confined space.     In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.146(c)(7)(ii): When it was necessary to enter the permit space to eliminate hazards, such entry was not performed under 29 CFR 1910.146(d) through 29 CFR 1910.146(k)      (a) Anodizing Department - On or about May 16, 2019, the employer did not ensure that when it was necessary to enter the Bright Dip Tank 7 to eliminate the hazard, the entry was performed under 1910.146(d)- (k). The employees entered the bright dip tank to test the Ph in order to determine that it was safe to enter.           In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. Each maintenance employee(s) performing work inside Bright Dip Tank # 7 did not affix a personal lockout device while replacing a roller screw hardware prior to performing the work.
