29 CFR 1910.30(a)(1): Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. On or about June 2, 2019, employees working in an aerial lift up to approximately 25 feet above grade had not received training to recognize and minimize fall hazards on the jobsite. Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR 1910.140(c)(18): Personal fall protection systems must be inspected before initial use during each workshift for mildew, wear, damage, and other deterioration, and defective components must be removed from service. On or about June 2, 2019, a fall protection system provided for employee use while working from an aerial lift had a rusted/corroded connector that did not close properly. The equipment had not been inspected and removed from service. Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR 1910.67(c)(2)(v): A personal fall arrest or travel restraint system that meets the requirements in 29 CFR part 1910, subpart I, shall be worn and attached to the boom or basket when working from an aerial lift. On or about June 2, 2019, an employee working in an aerial lift up to approximately 25 feet above grade was exposed to fall hazards. The employee was not utilizing a personal fall arrest or travel restraint system. Abatement certification is required for this item in accordance with 1903.19(c).
