29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a) Jobsite located at 7007 Elmwood Avenue, Philadelphia, PA: Employees working in a trench approximately 10 foot deep, 3 foot wide and 20 feet in length were exposed to struck-by/caught-between hazards in that, the spoil pile was closer than 2 feet from the edge of the trench.  Condition was noted on or about 5 JUN 2019.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  a) Jobsite located at 7007 Elmwood Avenue, Philadelphia, PA: The employer did not ensure that a protective system was utilized to protected employees from cave-in hazards while working in a trench that was approximately 10 feet deep, 3 feet wide and 20 feet in length.  Condition was noted on or about 5 JUN 2019.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Jobsite located at 7007 Elmwood Avenue, Philadelphia, PA: Employees who were working in an approximately 10 foot deep, 3 foot wide and 20 foot in length trench without protective systems, and a spoil pile closer than 2 feet from the edge  were not provided with training to recognize and avoid the unsafe work conditions.  Condition was noted on or about 5 JUN 2019.
