29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Worksite, 91 Quogue St. Quogue, New York - Employees performing framing work along the edge of the third level of the commercial building between approximately 7ft. to 9ft. above the second level did not have fall protection; on or about 06/04/2019. b) Worksite, 91 Quogue St. Quogue, New York - Employees walking and working along the edge of the second level of the commercial building approximately 10ft. above the ground did not have fall protection; on or about 06/04/2019. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. Instance a) Worksite, 91 Quogue St. Quogue, New York - Employees were using a 7ft. WERNER self-supporting ladder to access the third level of the commercial building approximately 7ft. above the second level. The ladder was approximately 5in. below the landing surface; on or about06/04/2019. Instance b) Worksite, 91 Quogue St. Quogue, New York - Employees were using a 24ft. portable WERNER aluminum extension ladder to access the second level of the commercial building approximately 10ft. above the first level. The ladder was approximately 5in. above the landing surface; on or about06/04/2019. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
