The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about May 31, 2019, located at a residential jobsite, employees were working inside a trench excavation greater than 5 feet in depth. The employer did not instruct employees in the recognition and avoidance of those trench excavation hazards while performing this work.

Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. On or about May 31, 2019, located at a residential jobsite, employees were exposed to struck-by hazards while working inside a trench excavation greater than 5 feet in depth without use of eye protection.
