29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to the work environment to control or eliminate any hazards or other exposure to illness or injury:  a) Jobsite: On June 5, 2019 and at times prior thereto employees worked in 6 to 8 foot deep trenches without a cave-in protection system in place.  Employees did not recognize or acknowledge the hazards of working in an unprotected area of a trench or the actions needed to minimize or control the hazard.     b) Jobsite: On June 5, 2019 and at times prior thereto a properly positioned ladder or other safe means of egress was not available in a 6 to 8 foot deep excavation.  Employees did not recognize or acknowledge the hazard of not having safe egress out of the trench or take action to correct the hazard.   c)  Jobsite: On June 5, 2019 and at times prior thereto employees worked in a 6 foot deep trench where the spoils pile was not placed away from the top of the trench.  Employees did not recognize or acknowledge this hazard and take action to minimize the hazard.     Note) Certification of corrective actions are required for these items.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Jobsite: On June 5, 2019 and at times prior thereto the top rung of an extension ladder was positioned approximately 3 feet below the top of the excavated trench wall.  The ladder was used by employees for access into and out of the 6 to 8 foot deep trench.        NOTE) Certification and documentation of corrective action is not required for this item.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  a) Jobsite: On June 5, 2019 and at times prior thereto employees were exposed to cave-in hazards while installing water pipe line in a 6 to 8 foot deep trench with no cave-in protective system in place.    b) Jobsite: On June 5, 2019 and at times prior thereto employees were not provided with a safe means of egress from a 6 to 8 foot deep trench.  The extension ladder used did not extend out of the trench.    c) Jobsite: On June 5, 2019 and at times prior thereto employees were exposed to struck-by hazards while installing water pipe line in a 6 to 8 foot deep trench where the excavated material was not placed back from the top of the trench wall.    Note) Certification and documentation of corrective actions are required for these items.
