29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:Note:  If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented.    (a) The Crossings at Southridge: On June 11, 2019, employees were installing a fourth floor subfloor at heights of approximately 37 feet, without the use of a fall protection system.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) The Crossings at Southridge: On June 11, 2019, an employee was assisting in the placement of a 2X10 beam while sitting on the framing of the third floor at heights of approximately 37 feet, without the use of a fall protection section.
