29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) Dualdraw, LLC at 4934 Lima St., Denver, CO: On and around June 13, 2019, the employer had developed but not implemented and maintained a site specific written hazard communication program. Employer Representatives had no knowledge of the written program on the first day of the inspection. The written program was not updated to the globally harmonized system (GHS) and did not require the use of GHS labels or safety data sheets. Employees were not trained about the program and the program did not have an administrator. This condition potentially exposed employees to hazardous chemicals, including but not limited to the following: 1) Galvanized (Hot Dipped) Sheet-Carbon Steel (during welding and grinding) 2) Klean Strip Lacquer Thinner 4) Cardinal Acrylic Enamel Aerosols 5) Gardolene D

The employer maintained material safety data sheets that had not been updated to safety data sheers for hazardous chemicals, including, but not limited to propane, Drano Max Professional Strength Gell Clog Remover, isopropyl alcohol, Mineral Spirits, WD-40, and Zep Stainless Steel Polish.

The employee exposure was below the action level and the permissible exposure limit for chromium (VI).

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling: (a) Dualdraw, LLC at 4934 Lima St., Denver, CO: On and around June 13, 2019, the employer did not ensure that two metal electrical outlet boxes in the central part of the shop were used in accordance with listed instructions, in that the outlet boxes in use on the flexible cords included pre-punched knockouts that could be dislodged by frequent handling and the boxes were not securely fixed to a surface, where they could be damaged or come into incidental contact with water, which could act as an electrical conductor. This condition exposed employees to electrical hazards while connecting and disconnecting electric-powered equipment at the outlet box at the end of a flexible cord.
