29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: On or about June 11, 2019, the employer did not ensure that an employee, installing framing material to a building, was in use of fall protection while working from an aerial lift. The employee was exposed to a fall hazard greater than six (6) feet to the ground below.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about June 11, 2019, at the jobsite the employer did not ensure that employees, performing framing work activities, were in use of fall protection and were exposed to a fall greater than six (6) feet to the ground below: 1) An employee, performing framing work activities, was working from a third story building by a window opening and was not in use of any fall protection. 2) Two employees were working from the roof of a building that was more than 6 feet to the ground and were not in use of fall protection.
