29 CFR 1926.651(a): All surface encumbrances that were located so as to create a hazard to employees were not removed or supported, as necessary, to safeguard employees:  a)    Northeast corner of Voorhees Animal Orphanage property, adjacent to property line with the VFD: An employee without any protection was working in an approximate 9-11 foot deep excavation in class C soil where unsecured trees were within approximately 3-5 feet of the edge, on or about 06/18/2019.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a)    Northeast corner of Voorhees Animal Orphanage property, adjacent to property line with the VFD: Employee had been working in the 9-11 foot deep excavation without any means of egress, on or about 06/18/2019.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a)    Northeast corner of Voorhees Animal Orphanage property, adjacent to property line with the VFD: Spoil, piled 4-6' high on the east and west sides of the approximate 9-11' deep x 20' around, came up to the edge of the near vertical faces of the excavation, on or about 06/18/2019;  b)    Northeast corner of Voorhees Animal Orphanage property, adjacent to property line with the VFD: Two trees within approximately 3-5 feet of the edge of the approximate 9-11 foot deep excavation toppled over into the excavation, on or about 06/18/2019.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
