29 CFR 1926.502(d)(6)(i): A snaphook, not of the design type, was engaged (i) directly to webbing, rope or wire rope; (ii) to each other; (iii) to a Dee-ring to which another snaphook or other connector is attached; (iv) to a horizontal lifeline; or (v) to any object which is incompatibly shaped or dimensioned in relation to the snaphook such that unintentional disengagement could occur by the connected object being able to depress the snaphook keeper and release itself:    (a) The employer is failing to protect employees from hazards associated with falls to a lower level, while installing drywall in a 44 inch wide trash chute approximately 38 feet above the ground. This was most recently documented on or about June 18, 2019 at the Muse Apartments construction site located at 1005 N 20th St, Omaha, NE 68102. Two employees were "tying-back" their lanyard to itself and were not using a lanyard designed to "tie-back."

29 CFR 1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person.          (a) The employer is failing to protect employees from hazards associated with falls to a lower level, while installing drywall in a 44 inch wide trash chute approximately 38 feet above the next lower level. This was most recently documented on or about June 18, 2019 at the Muse Apartments construction site located at 1005 N 20th St, Omaha, NE 68102. Two employees were not utilizing an approved anchorage point and were securing their lanyard to 2 x 4 wood framing by wrapping it around the framing and attaching the lanyard back onto itself.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.        (a) The employer is failing to ensure that employees exposed to fall hazards have been effectively trained on fall hazard recognition and the proper use of personnel fall arrest systems. This was most recently documented on or about June 18, 2019 at the Muse Apartments job site located at 1005 N 20th St, Omaha, NE 68102. Two untrained employees were working in a trash chute approximately 38 feet above a lower level while standing on 2 x 8 planks and were securing their lanyard around 2 x 4 wood framing rather than utilizing an approved/certified anchor point.
