(a) Boat Barn - Fishing Vessel (FV) Progress - On or about February 1st, 2019 and at times prior thereto, employees were potentially exposed to oxygen deficient or enriched atmospheres while accessing confined and enclosed spaces including, but not limited to: Fuel Oil Tanks #1 port/starboard, #2 port/starboard, #3 port/starboard, #4 port/starboard and Fish Holds #1-4 without a gas free competent person inspecting and testing for oxygen content. Employees were stick welding and cutting with oxygen and acetylene torches which can create an oxygen enriched or deficient atmosphere.

29 CFR 1915.73(d): When employees were exposed to unguarded edges of decks, platforms, flats, or similar flat surfaces, more than 5 feet above a solid surface, the edges were not guarded by adequate guardrails meeting the requirements of 29 CFR 1915.71(j)(1) and (2). (a) Fabrication Building - U.S.C.G 47254 Tillamook Bay - On or about June 17th, 2019 and at times prior thereto, guard rails were not installed around the topside weather deck of the vessel exposing employees to a fall of 12'. (b) Fabrication Building - U.S.C.G 47208 Siuslaw River - On or about June 17th, 2019 and at times prior thereto, guard rails were not installed around the topside weather deck of the vessel exposing employees to a fall of 12'. (c) Fishing Vessel (FV) Progress - On or about June 17th, 2019 and at times prior thereto, employees were exposed to a fall of 9' while working and transiting around the forecastle deck without adequate guardrails in place. (d) Fishing Vessel (FV) Progress - On or about June 17th, 2019 and at times prior thereto, Swing gates were not installed on the three (3) ships ladders access the engine room, mid-level, and pilot house. Each instance was approximately a 13' fall.

29 CFR 1915.112(c)(2): All sling chains, including end fastenings, were not given a visual inspection before being used on the job. A thorough inspection of all chains in use were not made every 3 months. Each chain shall bear an indication of the month in which it was thoroughly inspected. The thorough inspection shall include inspection for wear, defective welds, deformation and increase in length or stretch. (a) Fred Wahl Marine Construction, Inc. - On or about June 17th, 2019 and at times prior thereto, employees were exposed to failing rigging chain slings while lifting metal plates for use on the CNC machine, in that they were not inspected quarterly for wear, defective welds or deformation.
