29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  On or about June 27, 2019, on the southwest exterior corner of a new hotel under construction located at 1440 NW Federal Highway in Stuart, Florida, an employee was exposed to hazards associated with performing guardrail removal for window installation work prior to the employer providing an inspection of the worksite by a competent person to recognize potential hazards and determine the proper materials and equipment needed to perform the work safely.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:   On or about June 27, 2019, on the southwest exterior corner of a new hotel under construction located at 1440 NW Federal Highway in Stuart, Florida, an employee was exposed to a fall hazard of approximately 34 feet when performing guardrail removal for window installation work from a walking/working surface while not being protected from falling to the lower level.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   On or about June 27, 2019, on the southwest exterior corner of a new hotel under construction located at 1440 NW Federal Highway in Stuart, Florida, an employee was exposed to a fall hazard when performing guardrail removal for window installation work from a walking/working surface prior to being provided with training that would enable him to recognize the hazards associated with falls.
