29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided: (a) On or about June 24, 2019, and at times prior, the employer did not ensure that personal protective equipment for extremities was provided. An employee suffered serious burns to his right hand and wrist when he slipped and fell onto a mop cart containing 400 degree asphalt during flat roofing operations. The employer did not provide adequate gloves to protect the worker from hot work hazards. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.95(b): Where employees provide their own protective equipment, the employer did not assure its adequacy, including proper maintenance, and sanitation of such equipment: (a) On or about June 24, 2019, and at times prior, the employer did not assure the adequacy of "employee-owned" gloves. An employee suffered serious burns to his right hand and wrist when he slipped and fell onto a mop cart containing 400 degree asphalt during flat roofing operations. The employee was wearing his own nylon/polyester gloves which do not offer proper protection for hot asphalt work. The employer did not assure that the employee-owned gloves were adequate to protect the worker from hot work hazards. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
