OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards while working on unsecured vehicles rolled on their sides while parts and engines were removed:  a) On or about July 2, 2019, at the salvage yard, employees worked on the removal of engines, mufflers and other parts while the vehicle was flipped on its side with tires and rims used to prevent it from falling over, exposing employees to crush and struck-by hazards.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) On or about July 2, 2019, at the salvage yard, employees operating the Hyundai HL760-7A Loader had not been trained by the employer, exposing employees to struck-by hazards.   b) On or about July 2, 2019, at the salvage yard, employees operating the Komatsu WA380 Loader had not been trained by the employer, exposing employees to struck-by hazards.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye:  a) On or about May 22, 2019, at a worksite located in 552 Highway 441, Lady Lake, FL, an employee suffered a work related injury and was hospitalized.  The employer was aware of the in-patient hospitalization on May 22, 2019 at about 10:30 AM and did not notify OSHA.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) On or about July 2, 2019, at the savage yard, employees were exposed to chemicals, including, but not limited to Anti-freeze, Unleaded Gasoline, Diesel Fuel, Oil, Windshield Wiper Fluid, Brake Fluid, and Power Steering Fluid, while disassembling vehicles without the employer having a written hazard communication program.
