29 CFR 1910.22(a)(3): Walking-working surfaces were not maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice:    (a)Win Chill, LLC at 5050 West Foundation Court, Sioux Falls, SD 57107: On or about and at times prior to July 3, 2019, the employer did not ensure employees were protected from slip hazards when performing work in the dairy freezer including forklift operations.  Water accumulation during the defrosting of chiller units in the dairy freezer created ice on the walking working surface. This condition exposed employees to slip hazards.

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:    (a)Win Chill, LLC at 5050 West Foundation Court, Sioux Falls, SD 57107: On or about and at times prior to July 3, 2019, the employer did not ensure employees performing work using personnel baskets to access elevated materials on the racking systems within the coolers and/or freezers were protected from fall hazards when transitioning from the personnel platform to the racking system in that a fall protection system including only one lanyard was used to perform this task. This condition exposed employees to fall hazards greater than 4 feet above a concrete floor.
