29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following - guardrail systems, safety net systems, and personal fall protection systems:  a) Console Room Roof Surface: On or about June 21, 2019 the employer did not ensure fall protection was used while transiting on the roof surface between the forklift personnel lift basket and auger conveyor which  exposed an employee to injuries associated with a fall of 11-feet to the floor below.  b) Screw Conveyor:  On or about June 21, 2019 the employer did not ensure fall protection was used while climbing and working from on top of the conveyor which exposed an employee to injuries associated with a fall of 16-feet to the floor below.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation were be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly:  a) Nissan forklift: On or about June 21, 2019 and at times prior thereto, the employer did not ensure written approval and updated instruction plates, tags, decals were sought after and obtained prior to using a after-market personnel lift basket with the forklift which exposed employees to injuries associated forklift tip overs and other unsafe uses.  b) UniCarriers forklift: On or about June 21, 2019 and at times prior thereto, the employer did not ensure written approval and updated instruction plates, tags, decals were sought after and obtained prior to using an after-market personnel lift basket with the forklift which exposed employees to injuries associated forklift tip overs and other unsafe uses.
