29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program:  a) Production area: On or about August 6, 2019, and at times prior, the employer exposed the grinder operator to noise levels above the action level of 85 decibels (66% dose) without providing training.  The employee had an exposure of 90.4 decibels (106.6% dose) during the 395 minute sampling period. The exposure calculation included a zero increment for the 85 minutes not sampled.  b) Production area: On or about August 6, 2019, and at times prior, the employer exposed the grinder operator to noise levels above the action level of 85 decibels (66% dose) without providing training.  The employee had an exposure of 90.2 decibels (102.9% dose) during the 376 minute sampling period. The exposure calculation included a zero increment for the 104 minutes not sampled.   TKO Polymers, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1337331, citation number 01, item number 02c and was affirmed as a final order on February 7, 2019, with respect to a workplace located at 4215 Wendell Drive SW, #204, Atlanta, Georgia.
