29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 07/09/19, on a jobsite at a house at 195 Hodge Avenue, Buffalo, NY: Employees engaged in construction work including roofing & clean-up were not trained to recognize potential hazards on this type of jobsite, including but not limited to falls from roofs, ladders, scaffolds, and how to properly install, use, and maintain Personal Fall Arrest Equipment, and the need for personal protective equipment to protect them from various hazards. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 07/9/19, on a jobsite at a house at 195 Hodge Avenue, Buffalo, NY: One employee engaged in tear-off roofing work on the steep roof on the left side of the house was exposed to a fall of approx. 20 ft. because no fall protection was being utilized. Pitch of the roof was approx. 10 in 12. b) On or about 07/9/19, on a jobsite at a house at 195 Hodge Avenue, Buffalo, NY: One employee engaged in roofing work on the steep roof on the right side of the house was exposed to a fall of approx. 20 ft. because his Personal Fall Arrest Equipment was not used properly. The employee who was installing the ice shielding on the right side of the steep roof was wearing a harness, but no straps on the harness were fastened above his waist. Additionally, he had the lifeline connected to a ring on the front side of the harness. Pitch of the roof was approx. 10 in 12. NO ABATEMENT CERTIFICATION REQUIRED
