OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by injuries while using a Port-A-Wrap tool to lower tree sections: (a) Worksite: On or about 6/27/2019, the Port-A-Wrap tool was not used in accordance with the manufacturer's recommendations, in that the correct number of wraps of the rope was not used around the long leg of the Port-A-Wrap, causing the heavy section of tree to drop at a high rate of speed, pulling the rope through the employee's hands, lifting one employee off of the ground and slamming him into the company truck.

29 CFR 1910.138(a): The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasion; punctures; chemical burns; thermal burns; and harmful temperature extremes: (a) Worksite: On or about 6/27/2019, the employer did not require employees to use hand protection while the employees worked with ropes under tension, causing an employee to suffer severe rope burns to both hands.
