29 CFR 1910.28(b)(11)(ii): Stairways. The employer did not ensure each flight of stairs having at least 3 treads and at least 4 risers was equipped with stair rail systems and handrails per Table D-2: one stair rail system on each open side for stair width less than 44 inches (1.1 m) and two open sides: (a) MST Room - The metal stairs with five treads and six risers at the front of the Mixer platform, between Mixer 1 and Mixer 2, did not have a stair rail system on either open side in that the left side going down had no railing at all, and the right side going down had a railing consisting of only a top rail, exposing employees to the hazard of falling to the floor below, on or about July 17, 2019. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.30(a)(1): Before any employee was exposed to a fall hazard, the employer did not provide training for each employee who used personal fall protection systems or who was required to be trained as specified elsewhere in this subpart: (a) Plainville Brands, 304 S. Water Street, New Oxford, Pennsylvania - The employer did not provide training for each employee who used personal fall arrest systems before each employee had exposure to a fall hazard, including, but not limited to, maintenance employees who, for example, worked from the tops of Mixer 1 and Mixer 2 in the MST Room to disassemble and reassemble ventilation piping, exposing employees to the hazard of falling to a lower level, on or about July 17, 2019. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.140(c)(13)(ii): Anchorages were not designed, installed, and used, under the supervision of a qualified person, as part of a complete personal fall protection system that maintains a safety factor of at least two: (a) MST Room - The employer designated a horizontal hollow rectangular steel tube on a steel frame structure above the work platform for the MST mixers as the anchorage for use as part of a personal fall arrest system by maintenance employees who worked from the tops of Mixer 1 and Mixer 2 to disassemble and reassemble ventilation piping that connected these mixers to ceiling ductwork. A qualified person, meeting the definition of the standard, did not supervise the design, installation, and use of this anchor point as part of a complete personal fall protection system that maintained a safety factor of at least two, exposing employees who used the horizontal rectangular steel tube as an anchor point to the hazard of falling 4.75 feet from the tops of the mixers to the work platform and 8.5 feet from the tops of the mixers to the floor, on or about July 8, 2019. (b) MST Room - In and above the ceiling next to the ventilation ductwork for Mixer 1, the employer fabricated and installed an anchor point for use as part of a personal fall arrest system by maintenance employees who worked from the tops of Mixer 1 and Mixer 2 to disassemble and reassemble ventilation piping that connected these mixers to ceiling ductwork. A qualified person, meeting the definition of the standard, did not supervise the design, installation, and use of this anchor point as part of a complete personal fall protection system that maintained a safety factor of at least two, exposing employees who used the anchor point to the hazard of falling 4.75 feet from the tops of the mixers to the work platform and 8.5 feet from the tops of the mixers to the floor, on or about July 8, 2019. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
