OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to struck-by hazards as a result of being ejected from the seat of a rough terrain forklift:     (a)Time Equipment Rentals and Sales, Inc. at Wolf Creek School, Pine Ridge, South Dakota 57770: On or about and at times prior to July 12, 2019, the employer did not ensure employees were utilizing seat belts while operating the JLG Sky Trak 6036 Rough Terrain forklift.  An employee was severely injured when the rough terrain forklift he was operating fell off the side of a flat bed trailer during loading operations. The employee sustained multiple broken bones and a concussion after leaving the seat as the forklift drove off the trailer. This condition exposed an employee to crushing injuries requiring hospitalization.    Abatement Note: Among other methods, one feasible and acceptable abatement method to control this hazard is to follow ANSI/ASME B56.6-2011, Safety Standard for Rough Terrain Forklift Trucks, paragraph 6.2.1 states, "Before starting to operate the rough terrain forklift truck; (a) be in operating position and fasten seat belt."

Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

An employee was hospitalized with a fractured arm from an equipment loading accident in that, the employee was attempting to load a rough terrain forklift onto a flatbed trailer when the employee drove the forklift off the trailer. The employer failed to notify OSHA within 24 hours that an employee was injured and required in-patient hospitalization.    Abatement Required: All work-related in-patient hospitalizations, amputations and losses of an eye must be reported to the Occupational Safety and Health Administration within 24 hours of learning about the injury.  Report must include the following:    1.  Company Name  2.  Location of work-related incident  3.  Time of work-related incident  4.  Type of reportable event (amputation, loss of eye, in-hospitalization)  5.  Number of employees who suffered the event  6.  Names of the employees who suffered the event  7.  Name of a company management official and contact information  8.  Brief description of work-related incident    If the area office is closed, you must report any in-patient hospitalization, amputation, or loss of an eye by using either the 800 (1-800-321-OSHA) number or the reporting application located on OSHA's public web site at www.osha.gov.
