29 CFR 1926.62(l)(1)(i): 29 CFR 1926.62(l)(1)(i): The employer did not include lead in the program established to comply with the Hazard Communication Standard (HCS) (29 CFR 1910.1200), ensure that each employee had access to labels on containers of lead and safety data sheets, was trained in accordance with the provisions of the Hazard Communication standard and 29 CFR 1926.62(l), and ensure that all the following hazards were addressed: Reproductive/developmental toxicity; central nervous system effects; kidney effects; blood effects; and acute toxicity effects: a) Thurston Road, Rochester, NY - On or about and prior to 7/30/19, contractor employees working in an area where paint chips contained between 0.0409%-0.5506% lead. The controlling employer did not include lead in the program established to comply with the Hazard Communication Standard (HCS) (29 CFR 1910.1200): ensure that each contract employee had access to safety data sheets; was trained in accordance with the provisions of the Hazard Communication Standard and 29 CFR 1926.62(l); and ensure that all the following hazards were addressed: reproductive/developmental toxicity; central nervous system effects; kidney effects; blood effects; and acute toxicity effects. This work was all performed dry without the use of any water or devices equipped with an integrated water delivery system that continuously feeds water to the device. Contract employees were engaged in a task identified on Table 1, the controlling employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, and did not assess and limit the exposure of contract employees to respirable crystalline silica in accordance with paragraph (d) of this section. Contract employees dry swept and shoveled debris containing respirable crystalline silica from the floors. Bulk samples taken from the area revealed debris taken from the area contained 3%-10% crystalline silica. ABATEMENT CERTIFICATION REQUIRED
