29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) On or about 7/23/19 at a roof replacement project located at 1035 Beach Road, Cheektowaga, New York; employees were installing shingles on the roof of a 2 story apartment building with a 5 in 12 roof pitch and an eave height of up to approximately 20 feet. There was no fall protection in use.  NO CERTIFICATION ABATEMENT REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On or about 7/23/19 at a roof replacement project located at 1035 Beach Road, Cheektowaga, New York;  an extension ladders was used for access to the roof at the front of the building. The ladder at extended 1'-6" foot above the eaves.  NO ABATEMENT CERTIFICATION REQUIRED  Besroi Construction Corporation was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 1132269, citation number 3, item number 1 and was affirmed as a final order on 7/6/16, with respect to a workplace located at 61 John Alex Drive, West Seneca, New York.  Besroi Construction Corporation was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 1239120, citation number 2, item number 2 and was affirmed as a final order on 2/2/18, with respect to a workplace located at Bentgrass Run, Clarence, New York.
