29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) Brighton Rd., Barnegat, NJ: On or about August 5, 2019, a Breakwater Construction and Environmental Inc. employee was operating a CAT 308 E2 CR excavator near the unshored walls of a 13 foot deep excavation. As such the employee was exposed to caught in and crushing hazards due to the possibility of cave-in.
