29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical agents:  a)  At Lot 22 Cottage Loop, Cypress Village, Orange Beach, Alabama:  On or about August 6, 2019 and at time prior; the employer allowed his employees to operate pneumatic nail guns without eye protection while performing framing activities  exposing his employees to struck-by hazards.  THE ALVINO MARTINEZ DBA ALVINO MARTINEZ WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.102(A)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1392064, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON JUNE 24, 2019, WITH RESPECT TO A WORKPLACE LOCATED AT 1230 MAKO LOOP, LOT 28 WATERSIDE RESORT, GULF SHORES, ALABAMA.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At Lot 22 Cottage Loop, Cypress Village, Orange Beach, Alabama:  On or about August 6, 2019 and at time prior; the employer allowed his employees performing framing activities to work without fall protection exposing his employees to a fall hazard of 10 feet to the ground below.   THE ALVINO MARTINEZ DBA ALVINO MARTINEZ WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501 (B)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1360749, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON FEBRUARY 5, 2019, WITH RESPECT TO A WORKPLACE LOCATED AT 7028 STONE CHASE, WIND CREEK, GULF SHORES, ALABAMA.
