General-duty citation text
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushing hazards from equipment being operated on steep grades. A) On or about August 3, 2019, four employees operating and working around a GEHL RS6-34 Telescopic Handler were exposed to struck-by and caught-between hazards when the employer failed to follow the Manufacturers Operating Manual for grade limits. The equipment was operated on a grade of 19 degrees, causing it to tip over and pin an employee between the equipments boom and the ground. B) On or about August 3, 2019, four employees operating and working around a GEHL RS6-34 Telescopic Handler were exposed to struck-by and caught-between hazards when they used the equipment to pull the tent skin over the frame of a commercial event tent with the boom near full extension. Utilizing the equipment in this manner could cause it to tip over and pin an employee between the equipment's boom and the ground. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). On or about August 3, 2019, the employer failed to ensure that employees operating a GEHL RS6-34 Telescopic Handler had received the required training prior to allowing them operate the equipment. This exposed the employees to struck-by and caught between hazards. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
