29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about August 6, 2019, at the jobsite, the employer did not ensure that employees of subcontractor, installing wall frames on the second level of a building, were in use of fall protection. This exposed the employees to a fall hazard greater than six(6) feet to the ground below.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: On or about August 6, 2019, at the jobsite, the employer allowed an employee of a subcontractor to operate a powered industrial truck with an expired certification. This exposed the employees to struck-by and/or caught-in hazards caused by inexperienced operator.
