29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a) Jaski Corporation, DBA as RC Special Events at 1588 Riverside Avenue, Fort Collins, CO 80524: On or before August 8, 2019, the employer did not ensure that forklift operations were trained to operate the Big Jo and the Tent Ox forklifts. The operators' training did not consist of a combination of formal instruction, practical training, and evaluation of the operators' performance in the workplace. This condition exposed employees to the hazard of unsafe forklift operations.

The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. a) Jaski Corporation, DBA as RC Special Events at 1588 Riverside Avenue, Fort Collins, CO 80524: On or before August 8, 2019, the employer did not certify that the operators of the Big Jo and Tent Ox forklifts had been trained and evaluated as required by 29 CFR 1910.178(l) in the topics as outlined in 29 CFR 1910.178(l)(3).

29 CFR 1910.1200(e)(1): The Employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met. a) Jaski Corporation, DBA as RC Special Events at 1588 Riverside Avenue, Fort Collins, CO 80524: On or before August 8, 2019, the employer did not develop and implement a written hazard communication program that pertains to employee use of chemicals such as, but not limited to the following: 1. Simple Green 2. Degreaser 3. Solv-It Reclaim Solvent 4. ECOLAB Oven, Grill and Fryer Cleaner 5. Clorox Bleach This condition exposed employees to the unsafe use of chemicals.

29 CFR 1910.1200(f)(6): Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer did not ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked: a) Jaski Corporation, DBA as RC Special Events at 1588 Riverside Avenue, Fort Collins, CO 80524: On and before August 8, 2019 the employer did not ensure that each container of degreaser and Simple Green in the workplace was labeled, tagged or marked in accordance with 1910.1200(f)(6)(I) or 1910.1200(f)(6)(ii) of this section. This condition exposed employees to chemical hazards. Abatement note: 1) 29 CFR 1910.1200(f)(6)(i) provides: The information specified under paragraphs (f)(1)(I) through (v) of this section, for labels on shipped containers; or 2) 29 CFR 1910.1200(f)(6)(ii) provides: Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.
