29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  (a) Martin Schwartz DBA M and E Builders on or about August 7, 2019 at the address of 5670 US Route 127, Celina, OH: The employer failed to ensure that an employee operating a fork truck was adequately trained. Untrained forklift operators are  hazardous to other employees working in the direct vicinity, such as not ensuring attachments are secured to the forks and overloading by attaching platforms that are too large for the lift, increasing the likelihood of tipping and rollovers.

(a) Martin Schwartz DBA M and E Builders on or about August 7, 2019, at the address of 5670 US Route 127, Celina, OH: The employer did not ensure the scaffolding platform (Fabricated steel mesh and frame) used to elevate employees via forklift, was designed and loaded on to the fork lift by a qualified person. Employee installing  OSB to the side exterior of the structure in this condition was exposed to a fall of approximately 20 feet.

(a) Martin Schwartz DBA M and E Builders on or about August 7, 2019 at the address of 5670 US Route 127, Celina, OH: The employer did not ensure a platform attachment was securely attached to the forks of the Gradall rough terrain forklift. Employees performing wood framing activities from the platform in this condition were exposed to a potential fall of 20 feet.
