29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) On or about August 8, 2019, the employer, Shark Excavation, LLC d/b/a Shark Sewer, did not ensure the excavation was inspected by a competent person so as to determine if a cave-in, from any possible sources, could result and potentially cause injury to an employee.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): a) On or about August 8, 2019, the employer, Shark Excavation, LLC d/b/a Shark Sewer, did not ensure employees were protected from cave-in hazards while engaged in sewer pipe repair operations in an excavation, which measured approximately 8 feet in depth. The employer was using one shore to protect employees. This was, however, not adequate as an additional, adjacent side was unprotected and had the potential to cave in.
