29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about August 14, 2019, an untrained employee was allowed to operate a powered industrial vehicle (e.g. the company's JLG scissor lift) at the site without having received formal instruction, including operator evaluation to determine the retention of the information.

1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. On or about August 14, 2019, the employer did not ensure that the #10 line, located in the Laminate 540 department was effectively guarded. The hazardous condition on the line includes; but is not limited to, the following: a. The mat cutting machinery, loaded and used by employees during the production of fiberglass mats; was unguarded. Employees were not protected from hazards created by rotating parts or caught by hazards created by the pneumatic clamp. Although emergency stop devices (e-stops) were affixed to the machinery, they were inadequate in that; the palm or mushroom-head type button was missing which restricts and/or prevents the operators ability to quickly shut-down the machinery in the event of an emergency.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: On or about August 14, 2019, the employer failed to ensure that all employees were trained on the hazardous chemicals utilized in the workplace. Chemicals used at the site include; but are not limited to, oils and lubricants, propane and acid batteries, Vinyl Toluene.
