29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  (a)Short Excavating at Main and Park Drive, Lennox, SD 57039:  On or before and at times prior to August 15, 2019 the employer did not ensure did not ensure that daily inspections of a trench, that was over five feet in depth and the adjacent area were made by the competent person for evidence of a situation that could have resulted in a hazardous condition, in that the competent person did not identify that the trench had near vertical walls and no soil analysis was conducted.  This condition exposed employees to a crushing hazard by trench wall cave-in.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:    (a)Short Excavating at Main and Park Drive, Lennox, SD 57039:  On or before and at times prior to August 15, 2019 the employer did not ensure employees were trained on the proper use of ladders being used on site and ability to recognize the hazards associated with ladder usage.  Employees on site were utilizing an extension ladder to access an excavation approximately seven feet in depth without training on its use.
