29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    (a)Jason Bruns Construction dba JBC, LLC at 113 West 3rd Street, Lennox SD, 57039: On or about and at times prior to August 15, 2019, the exposing employer did not ensure that employees were protected from injury, in that employees engaged in re-roofing activities on a two-story residential home were not utilizing a fall protection system. This condition exposed employees to a fall hazard of approximately eight feet to twenty-two feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a)Jason Bruns Construction dba JBC, LLC at 113 West 3rd Street, Lennox SD, 57039:  On or about and at times prior to August 15, 2019, the exposing employer did not ensure that each employee engaged in roofing operations on a residential single-family home, had been trained to recognize the hazards associated with working at elevations over six feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working onsite had not received fall protection training before working at elevations over six feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    (a)Jason Bruns Construction dba JBC, LLC at 113 West 3rd Street, Lennox SD, 57039: On or about and at times prior to August 15, 2019, the exposing employer did not ensure that each employee was protected from falls from heights in that, employees were utilizing ladders to gain access to the roof that were not extended at least three feet above the upper landing surface. This condition exposed employees to a fall hazard over six feet.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. The condition exposed employees to the hazard of falling from elevations over six feet.
