29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: On or about August 21, 2019, and at times prior thereto, at a commercial construction site, the employer did not ensure siding employees using a JLG 400S lift used a safety harness and lanyard. The employees were exposed to fall hazards of approximately 12 feet or more to the concrete below.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: On or about August 21, 2019, and at times prior thereto, at a commercial construction site, the employer did not ensure employees were provided hazard recognition and how to avoid the hazards where employees were elevated in a JLG 400S lift without the use of a safety harness and lanyard. The employees were exposed to fall hazards of approximately 12 feet or more to the concrete below.
