29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems. On or about 21 August 2019, and at times prior thereto, overhead storage on the ceiling of the main lobby and office was in excess of four feet in height without fall protection on the unprotected edge, exposing the employees working in the overhead storage area to a fall hazard of approximately 10 feet to the concrete slab below.

On or about 21 August 2019, and at times prior thereto, an LPG forklift was not placed out of service due to unsafe operating conditions, such as deteriorating tires, using ignition wires to start, and loss of hydraulics, exposing the personnel using the forklift to the hazard of being struck by the load or the forklift.

29 CFR 1904.39(a)(1): Within eight (8) hours after the death of any employee as a result of a work-related incident, the employer did not report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor. [5752 Highway 6 South, Hearne, TX 77859] On 19 August 2019 at approximately 1:08 PM, an employee was working underneath a vehicle supported by welded tire rim stands which slipped out causing the vehicle and stands to fall upon the employee. The employee died as a result of the incident and the fatality was not reported to the Austin Area Office of the Occupational Safety and Health Administration within eight (8) hours. Notice of the event to OSHA occurred at 4:00 PM on 20 August 2019, or approximately 27 hours later.
