29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about August 21, 2019, the employer did not ensure employees were in use of fall protection when working from heights greater than six (6) feet. This exposed them to fall hazards as follows: a) An employee was performing roofing work activities from a roof and was exposed to a fall to the roof below. b) An employee was performing roofing work activities from the main roof of the building and was exposed to a fall to the ground below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. On or about August 21, 2019, the employer allowed employees to use extension ladders to access the roof and did not ensure that the ladder side rails extended a minimum of three (3) feet above the landing. This exposed the employees to a fall hazard: a. A ladder was set up on the roof of the main building near the north end and was used to access the roof of the cupola. b. A ladder was set up to access the roof of the overhang in front of the building.
