29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) New townhome construction located on Lots #50-54, North side of the structure on Sonnet Walk: On or about 08/21/2019, and at times prior, the employer allowed employees to operate rough terrain powered industrial forklift trucks without certification, evaluation, and training on the type of truck they were operating.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews: (a) New townhome construction located on Lots #50-54, Northwest corner of the structure: On or about 08/21/2019, and at times prior, the employer exposed employees to fall hazards of approximately 26-feet to the lower level, in that end rails were not installed on the open ends of the scaffold platform located 5-sections high from the lower level.
