29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On August 28, 2019, located on the east side of a low slope pitch commercial roof, an employee was exposed to a fall hazard working at the edge of the roof removing a rooftop air handler unit without a fall protection system installed and utilized. Potential fall height measured to be 16'-3" with a roof pitch of 3/12.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. On August 28, 2019, located on the east side of a low slope pitch commercial roof, the employer failed to install a fall protection system prior to an employee working at the edge of the roof removing a Rooftop Air Handler unit. Potential fall height measured to be 16'-3" with a roof pitch of 3/12.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. On August 28, 2019, located on the east side of a low slope pitch commercial roof, an employee was exposed to a fall hazard while performing HVAC work while not utilizing an adequate fall protection system and had not been trained by the employer to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. Potential fall height measured to be greater than 16 feet above the ground below with a roof pitch of 3/12. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
