29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about September 5 2019, the employer did not ensure that excavation equipment, and spoil piles were set back at least two (2) feet from the edge of the excavations, exposing employees to struck-by hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about September 5, 2019, the employer did not ensure adequate protective systems were provided for employees working within an excavation that was more than five (5) feet in depth. This exposed the employees to cave-in hazards. The employer Allen Contracting Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1216325, citation number 1, item number 1, and was affirmed as a final order on 06/09/2017, with respect to a workplace located at Corner of 50th and Sewell Oklahoma City, OK 73111.
